Building and design professionals have until July 30, 2021 to prepare for compliance with the new Design and Building Practitioners Act (NSW) and its Regulations, which have been released in draft form. 
 
This means that Engineers, Architects and Builders will all be impacted, and their legal counsel/advisors will also need to be very much aware of the impact these new regulations will have on their businesses. The laws are commencing in NSW soon and their impact will be closely monitored in other States.
 
Helen Kowal from Swaab lawyers in Sydney will present on the new compliance and penalty provisions in force from 1 July 2021 for engineers, architects and builders.
 
Danial Webber from Webber Insurance in Adelaide will present on the impact that these laws will have on practitioner’s insurance requirements (both business and professional indemnity).
 
Geoff Hanmer from ARINA will moderate the session and discuss the impact on Engineers, Builders & Architects.


Discussion will focus on the following:

  • Obligations of engineers, architects, designers and builders under the Design and Building Practitioners (DBP) Act 2020 and its Regulations.

  • Arrangements for the registration of practitioners. (Awaits the issue of procedures by Fair Trading NSW and the finalisation of Regulations.)

  • When does the legislation apply to you?

  • The role of the NCC and referenced standards in the preparation of a complying design. Is a practitioner required to comply with secondary standards?

  • What do you need to do to comply with the legislation?

  • Penalties and disciplinary action if you do not comply.

  • Required qualifications and skills to be a registered practitioner.

  • The design compliance declaration and its implications.

  • Are design practitioners required to inspect or certify designs on site?

  • Additional Continuing Professional Development requirements under the DBA Act.

  • The Code of Practice for registered practitioners.

  • Who needs to be insured under the new legislation?

  • What is ‘adequate insurance’ and how much cover will you need, and will your insurance meet the required standard?

Daniel Webber is a Director of Webber Insurance Services with 14 years’ experience in the insurance industry.  Daniel specialises in insurance for the construction industry, namely engineers, design professionals and builders.  Daniel is a Qualified Practicing Insurance Broker (QPIB), a Senior Associate for Australian Institute of Insurance and Finance (ANZIIF) and holds a Diploma of Financial Services (Insurance Broking).
